Welcome to GetSparked.pro (the “Site”). These Terms of Service (“Terms”) govern your use of the Site and the free and paid services offered through it. By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Who can use the Site
You must be at least 18 years old and able to enter into a binding contract to use the Site or purchase any product.
2. Acceptable use
You agree not to:
- Break any applicable law or third-party right.
- Scrape, reverse engineer, or attempt to extract our underlying code, models, or prompts.
- Resell or sublicense our tools except as expressly permitted.
- Submit unlawful, infringing, harassing, or malicious content.
- Use our services to build a competing product or to train any AI model.
We may suspend or terminate access if we reasonably believe you’ve violated these Terms.
3. Your submissions
When you complete a form, quiz, or share information with us, you confirm it’s accurate and that you have the right to share it. Please don’t submit sensitive data such as government IDs, full payment-card numbers, or protected health information.
You grant us a limited license to use your submissions to deliver the services to you. We don’t sell your submissions and don’t use them to train AI models.
4. Intellectual property
The Site, our content, tools, and branding belong to us. You keep ownership of what you submit, and of deliverables produced specifically for you under a paid engagement, subject to the terms of that engagement.
5. Paid products
Digital products (like the Spark Finder Quiz) are delivered instantly and are non-refundable except where required by law. Done-for-you packages (Blueprint, Launch, retainers) are governed by a separate engagement agreement that covers scope, timeline, and refund terms.
6. AI-generated content
Our tools and deliverables use AI to generate output based on your inputs. AI output can be incorrect, incomplete, or outdated. Always review and verify before acting on it.
7. Not professional advice
The Site and our services are for informational and business strategy purposes only. They aren’t legal, financial, medical, or other professional advice. Consult a qualified professional for decisions in those areas.
8. Disclaimers
The Site and services are provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to the Site or services won’t exceed the greater of the amount you paid us in the 12 months before the claim or US$100. We aren’t liable for indirect, incidental, or consequential damages.
10. Changes
We may update these Terms from time to time. The “Last updated” date above will reflect any changes. Continued use of the Site after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles.
